A member of the professions holding an advanced degree (EB2-1) or a professional possessing a bachelor's degree (EB2)
Foreign national faculty and professionals who desire permanent resident status may be eligible to immigrate to the U.S. under the employment-based immigration classifications for professionals holding an advanced degree (EB2-1) or professionals possessing a bachelor’s degree (EB2). Foreign nationals who instruct courses in a classroom setting may qualify for immigrant status under the University and College Teachers category. Those who do not meet this requirement may file under the Professional Occupations category.
University sponsorship under both employment-based immigration classifications, EB2-1 and EB2, require the university to file an Application for Permanent Labor Certification with the Employment and Training Administration (ETA), a Department of Labor agency. A Permanent Labor Certification is a prerequisite to filing an employment-based immigrant petition under the category of EB2-1, or EB2. The University must produce evidence that recruitment activities associated with the applicable position were conducted in a manner that meets ETA standards.
