Standard Processing Cases for Non-Teaching Professionals

Sponsorship under the Standard Processing category EB2-1 or EB2-2 requires the University to conduct recruitment activities in six specified types of venues. The purpose of the required recruitment process is to provide evidence to the DOL that those U.S. workers (U.S. citizens or Permanent Residents) who meet the minimum qualifications for the position have been provided with an opportunity to apply for the position in question and subsequently have been provided an opportunity to fill the position. A minimally qualified U.S. worker cannot be denied consideration for the applicable position unless there are legitimate employment-related reasons that can be provided as evidence to the ETA.

Deadlines                         

The Application for Alien Employment Certification (ETA Form 9089) for Standard Processing cases must be filed no later than the 180th day that follows the date that the first advertisement for the applicable position appeared in any of the required venues. This means that all advertising periods must have begun no more than 180 days before filing the Permanent Labor Certification application. However, only one of the advertisements may have a posting end date that falls within 30 days of the applicable filing date. Therefore, the posting period for all advertisements for Standard cases must occur within a period of approximately 150 days.

 

If a Permanent Labor Certification application for a Standard case is not filed within 180 days of the date that the first advertisement began to post, the recruitment activities must be repeated. The ETA deadlines are strictly enforced and appeals are not permitted.
